If he refused to get tested then how could he be guilty. He wouldn't have known he had aids even if he had symtoms.

If he knew he had aids and she asked him if he did and he lied saying he didn't and then she had unprotected sex with him then he did something criminal and deserving a judgement against him. If anyone of the above did not occur I don't think you can hold him criminally or financiallly responsible.
