Silly lawsuit, but it might work. There is an obligation to to keep your guests free from hazards. This is a stretch however.

Since they waited until the near limitation to file it, there is a chance that means they weren't sure it was worth it (but that could also mean other things).

Instead of "physically attractive" they should have described her as "desirable to the intoxicated males (and females) normally found occupying these premises." The burden of proof would be easier to meet.

i have always wondered why (in cases like this) it can take the plaintiff so long to decide to sue?

sounds like she would like to see all the bars closed or have them stop serving booze - anywyas, it is always someone else's fault......

Ridiculous law-suit.

Now don't get me wrong, I think clubs like the roadhouse blow and love to see them get smacked around when possible but no one forced her on the dance floor and I'm pretty sure no one forced her to drink that much liquor. Her own drunken stupidness led to her breaking her arm.

The only way I can see her getting any money (definitely not 500,000) is if someone who worked there went up and asked her if she wanted another (which is a big no no in a lot of provinces and would also lead to a hefty fine for the club and whoever over served her) but from my club experiences I always had to go to a bar or beer tub and ask for drinks.

Also I don't find her attractive in the slightest.

^^^ I guess I was being a little sarcastic - as a shot of her posing with a Palm Bay (which as an aside are quite tasty) with a couple of 2sixers in the foreground should help the law talking guys for the Roadhouse determine that she likely was aware of the effects of alchohol......
