If you feel that there is any damage done to your personal property (including smoke damage) your homeowner's policy (assuming you have some) will probably cover it. It will also cover the work done by a restoration company.Trust me...they will subrogate (a fancy insurance term for collect from) against whoever may have been liable for the damages caused...legal action, if required, will be handled by them.
Homeowner's/tenant's insurance is well worth the money. It protects you from damage to your own property but also protect you from liability if you may have been at fault for property damage. For example, if you are liable for a fire (left on an iron or something) that damaged your neighbours house, you can be subrogated against if you don't have an insurance policy. That could mean that you have to pay for 20-30 years for damage caused by your mistake.
