Many offences are hybrid offences and can be charged either way. Depends on the seriousness of the crime and record of the accused I think. There are other levels here too, such as the identity theft of the realtor. I know that realtor, and I'm sure he'd support some hard justice.

Let him be. Trust that the justice system will rehabilitate him and he will come out a better person and human being. The crimes committed against you will act as a platform for the person to make the world a better place.

If the guy is convicted, the court should be able to order restitution, so no need to go to small claims to get your order.

It's also possible Alberta has a victims compensation fund, but I have my doubts you'd be at the top of their list.
