The cops will likely want to get your statement and have you involved in the trial at least as a witness. In regards to the small claim suit, you won't get anything out of it other than, and this is more than worth it in my opinion, having a judgement appear in collections on his credit report for a long time (I think they stay on for longer than seven years and even after they are paid). If nothing else, you will cause him financial stress in the future. It's a chance to keep turning the screws on somebody.

I'd be more than happy to have this guy financially screwed for a long time, and I'm sure the other victims would say the same.
I will definitely try getting in touch with the officer who spoke with us.

Can this guy be charged with an indictable offence? Or does this merit a summary conviction?

I have never had a bad experience using kijiji before this situation. But I am going to make a lot smarter decisions going forward.

Many offences are hybrid offences and can be charged either way. Depends on the seriousness of the crime and record of the accused I think. There are other levels here too, such as the identity theft of the realtor. I know that realtor, and I'm sure he'd support some hard justice.

If the guy is convicted, the court should be able to order restitution, so no need to go to small claims to get your order.

It's also possible Alberta has a victims compensation fund, but I have my doubts you'd be at the top of their list.
