There is nothing here that couldn't have been foreseen, we know full well that the deal may be ilegal, will be challeanged and that uncertainty will affect the price of the bonds.
But that's the whole point, if it weren't for the high interest rate the deal would have gone through. Now the issue isn't about the legality of the deal (at least from the city's perspective), its the actual financial viability of the deal at the high interest rate. Winning the lawsuit would be just be a Pyrrhic victory if they can't pay off the bonds.

They have a law, they have to live with the effects of the law, they have to structure deals in order to live with the effects of the law.
Seriously the GI are just doing their job, the city screwed the pooch on this.
They are a right wing think tank, much like the Fraser Institute here, they get no direct benefit from this, although as a right wing think tank in an incrediably right wing state, if they can sink the deal through the application of the law, they obviously will get more donations and raise their profile.
I should point out they are a very respected national organization, not just some local group of nimbys

Doing nothing means that the deal will fall apart soon. Issuing the bonds means that something will be done, and at least the courts can take care or it. At least then there is a slim chance that the deal can go through.
Let me know if that's not correct.
The issue is that they won't/can't issue the bonds at the current rate, a rate that has been driven up by the threat of litigation. They can't just go ahead with it based on current market conditions.

What are you talking about? Predicatable or not the price has been impacted, and you don't get to just "go ahead with the deal", you actually need these people called buyers.

Of course, but when the City is working out its funding formula a legal challenge by the GI is not a suprise, nor unfair, its what they do.
That a predictable challange will impact the return means the city either needs to sort out the legality first (and there has to be a way to do that) or work out a different financial solution.

After your president changed the rules on Bonds in the GM bailout Glendale/Coyotes does not even need to go out of business to forfeit the responsibility to pay. Anyone stupid enough to invest the Coyotes deserves to take a haircut---- paraphrasing Mr. Obama.

They turn up on TV now and then as well, they have been around a long time and do what they do, I am not a supporter of their philosophy or aims but they are, within the context of their community (right wing US politics) established and respected, Arizona is, to a large degree, the spiritual home of the Tea Party, the Goldwater Group may be a small state level group, but I think you underestimate their importance in helping establish that philosophy.

I'm sure that within their political movement they get all sorts of high fives, but that does not equal a nationally respected group. Heck, they aren't even involved in national issues. They are a local action group, nothing more.
