The grievance doesn't prevent that. It only determines whether the Sharks owe him compensation for letting him go. That compensation, whenever it is determined, will presumably count against the Sharks' cap.

IIRC, the NHL only investigated whether Kane had actually been betting on NHL games. They found no evidence of that, so he was not subject to league discipline. But the Sharks had other grounds for voiding the contract, and it appears neither the NHL nor the NHLPA nor Kane himself are fighting that. It's just a question of whether he (read: his creditors) gets paid.
