Well they couldn't do it when the Republicans got the super majority (that's how they got the super majority to begin with).
They could do it now, but they don't have the votes to over-turn the filibuster. And you also just get in a position where the Republicans just do the same when they get in control and you end up with a 900 person supreme court and a countries who's laws ying yang every 4 years.
