What would have been the penalty, other than they wouldn’t have been allowed to play Kucherov in the last two weeks?

You can't just not play a player if he's healthy. You can healthy scratch him, but he still puts you over the cap and there are penalties.

Some posters are acting like it's only a couple posters here that feel like TB were up to no good. those thoughts run league wide. Of course it is "legal", which is the punchline.

They would have had to dump salary. Since the trade deadline had passed, it would have meant waiving enough salary to add Kucherov back to the line-up.

Tampa would have been stupid to activate him sooner, but based on a report from one of Tampa's practices before the end of the season, he was going full throttle. By the letter of the law, if he was ready, they should have activated him and dealt with the consequences. The thing is, it's hard to prove and the NHL didn't seem compelled to dig into it too hard.

^^^when the 2009 Flames were “over the cap”, they didn’t have to waive anyone, they just played a few games without a full lineup.

Cost them the division.

Is that no longer something that can happen?

Right. I’m just saying I don’t understand the “undiagnosed injury” thing. That’s just not what happened.

TBL did, in fact, try to dump salary at the beginning of the season, unsuccessfully, when they waived Johnson.

The other exaggeration of the cap overage is that its not prorated, like when teams acquire a guy towards the end of the season.

Heck, even when he opted for the surgery, most people predicted this would happen. Everyone knew the plan. Kucherov opted for the surgery that most players opt to have in the off season so that Tampa could sign their RFAs. Totally their right though, so I have no issue with that. The only issue I have is that I tend to believe he was healthy before they said.

The aforementioned Seguin actually had the same surgery twice, both during the offseason. The normal recovery time is about 10 weeks, but it can vary quite a bit, making Kucherov's IR time within the realm of being believable if not for the journalists who saw him playing full contact scrimmages long before the playoffs began.

Yeah I agree, how would the NHL prove it? Can't say I know the ins and outs of the process so I am just guessing, but if the TB team doctor (under instruction from management) argues he needs to be kept out for another couple weeks for his long term health how would they dispute it? Even if NHL has their own objective doctors to investigate, it's one medical professional's word against another.
No player wants to sit out if they are healthy. So it's not like he sat out for months healthy. But if you are getting instruction from management to sit for just two more weeks so your team has a better chance in the playoffs what player is going to stand up and say 'FU, I'm playing!'?
The fact is it's within the NHL rules, it's just TB taking advantage of the rules. I am still comfortable calling them cheaters.

The normal recovery time I saw was 5 months (or more), which placed his return at May 30. He didn’t play full contact scrimmages until May 4, only a couple weeks before the POs. Kucherov was skating alone in March and with the team in a non-contact jersey in mid-April.

I think that was a little different. They couldn’t call anyone up because it would put them over the cap. They didn’t save any money by virtue of not having a full lineup as all the hurt guys were already counting against the cap.

Kucherov is different. I don’t know what would have happened. Waive someone that is guaranteed to be picked up I guess?

Right, if I’m remembering correctly, one of the D got hurt too late in the year to be placed on LTIR. Sarich, I think.

They should’ve made them waive someone.

You know the league would’ve made us waive ROR following the offer sheet fiasco

Good god Pat Maroon could be on his way to a third straight cup. You sure don't need to be smart to be successful..... he just has a vacant expression on his face at all times. The elevator just doesn't go to the top floor there.

This is totally off topic but that commercial made me think - with things opening up and the draft being in a month, has the NHL left it open that they could have the draft in person or have they already confirmed it'll be done remotely again?
