Minimum is still zero - he could conceivably convince them.  
 
But what it means is that he can get more than 5 games or $5K.  A phone hearing means a max of those two.

I think the issue is two fold.
 
 Its not in the first time Gio has injured a player when his knee was the principle point of contact. 
 
And lets face it if a "star player" is hurt the league is going to look more closely.

			What's Lomberg supposed to do - say "no" when asked to go on?  
 It should be a rule about Peters, although he didn't necessarily send him out to specifically attack Dumba.  He could have just figured something might happen, so better put him out (instead of, say, Gaudreau).  Especially if Dumba or someone else decides to run at someone else.

			And yet if the refs had called the empty net trip on Minny which should have resulted in an automatic goal for the Flames and game over, none of this would have happened. So once again, incompetence of refereeing causes a team and players to pay for it. Sad.

If they look at things Gio did that were not the subject of previous discupline, that's an appealable result IMO.  It's not in the rulebook.  Only previous DPS stuff is considered a player's "history".  And even then there's a time limit.

 I’m not going to defend Gio’s play either. Sloppy defending (no intent) that led to an injury. Not the first time he has taken out someone’s knee due to bad positioning either.
