You guys realize this applies equally to Luongo and the Canucks, right? When that trade got made and everyone realized that recapture was retroactive to deals signed pre-CBA there was much rejoicing.

Yes, it has retroactive effect.

It's a contract, which is the point. You can always amend or affect prior contracts in a new one.

Yeah I don't understand how this is in debate at all.

Contracts can be modified at any time, even retroactively if all the parties in the contract agree to it.

You would think if there was any legal standing to fight such a thing, the players would have tried it when all their salaries were rolled back by 5% in the 2005 CBA. But of course they couldn't because as a union they agreed to accept the rollback.

of course, this is all theoretical, and, even at age 37, Hossa is leading this team in Goals (tied with Anisimov)...I don't think that Hossa would be the one that's moved, nor, do I foresee his retirement as imminent. I think that, for the 'Hawks, a package of youngsters at $650 to $900K per contract, for "future considerations" as a deal to Vegas to take Kruger's $3M, in the draft is the likely route to cap relief. Depending on how many youngsters get thrown in, out of the pool of Kempny, TVR, Motte, Hinostroza, Schmaltz, Kero, Forsling, will be anywhere from about $4M up in relief...again, also, $2.2M "dead" cap space with Rundblad and Scuderi also comes off the books.
