It's the 'reasonable grounds' part of this one that would trip this up. The person filming would have a very hard time convincing an officer/judge/jury that he felt he was in such physical danger of force from having his cell phone camera pushed away that he felt justified in feeding the lady he was filming a few shots.
It's the 'reasonable grounds' that trip a lot of folks up.

Were you by any chance raised in the 50's? Telling a Chinese person to go back to their own country isn't racist?
Jeez now imagine only one person has called you out, just amazing. I guess hitting a racist who assaults you first is a lot worse than your interpretation of what a racist is.

Okay, I was confused by the thread title but I'm clear now.
I thought the dog was racist. But no, just the lady.
Good. I hate racist pets.

I've seen a number of posts here saying that video taping was the wrong thing along the lines of "shows he was not able to take care of things on his own".
So, if someone in your neighborhood is ignoring the leash bylaw and the dogs are being a nusaince, how do you "take care of things on your own"? If the police in Calgary are not even coming out for stolen property are city bylaw officers willing to come out to investigate unleashed dogs?

and they've come so far, to hold them back, by not hitting them

Oh nice, just cut and paste some code and leave it at that. A convenient way to not burn up any brainpower by actually thinking about how that code is applied.
Let's walk through it slowly.
If a person shoves you, it does not grant you a free pass to shove them back. That's where the reasonable grounds part comes in. If we go by your logic, or lack thereof, getting shoved out of the way by someone who then walks past you would give you the right to chase them down and shove them in the back. I don't think you're going to find a case out there that supports that conclusion.

You know what, I get where you're coming from but I have to disagree. Some people are such absolute raging c$ntmuffins that they simply do not care about complying with societal rules unless there are personal consequences for them. For some, calling them out on it out loud, even when no one else is around, is enough. If it isn't, if they're big enough pricks not to be ashamed and aplogetic when their lameness is pointed out to them, that shouldn't be the end of it. If he can make someone who's blatantly flouting a rule that exists for the benefit of others feel uncomfortable for doing so, more power to him.

There's no point in a pile-on. Unless it's a puckluck pile-on.

9 hours later for me as well. But that's beside the point. I'm done with this thread, it's obvious whose true colors have shown. I don't go looking to "abuse" women but I'm not putting up with anyone laying their hands on me. Never been in "cuffs" so I'm not worried about ever being in that position. But if I ever am arrested for defending myself then so be it, I'm fine with that. I know my morals and will not allow no one to lay their hands on me since I never touch anyone without them hitting me first.
That lady would deserve everything she got if the Chinese guy fought back. And I'd have no sympathy for such an ignorant human being.

hmmm, you have lots of people hitting you first.
The women's comment are disgusting. I wonder if she would be upset with me, a white, blond haired, no accent, immigrant?

The courts will take in to the size difference, gender, etc and the circumstances involved. However if two people of equal size and gender shove eachother there is no offense. If two people consent to a fight and punch eachother with the possible exception of causing a public disturbance there is no offence. If during the course of that fight one of the person's says stop and the other continued to hit him then that would be assault. I challenge you to find case law that says otherwise. If you are outside a bar and somebody shoves you, you have every right to shove them back. If somebody hits you, you have grounds to hit them back. Of course you cannot justify that action if the person were disabled, a child, much smaller, and other factors but if some guy hits you out on the street you can hit him back. If some guy spits on you on the street you would be justified in hitting him back. No court or judge would convict you on it. I know exactly how the code is applied because I work in law enforcement, what do you do valo? Your example of somebody shoving their way by is ridiculous and was never my point and you know it.

Thus why I said I agreed that you could not hit this woman in those circumstances. valo is saying if somebody punches you that you have no rights at all to hit him back. He is wrong.

I fear we still have plenty of people like that in Calgary. There was guy the other day at downtown station yelling for people to get "the ###### back to your damn rice paddies".
