It was clarified by Bob McKenzie yesterday that he would have been automatically placed on waivers upon completion of the contract. Or something to that effect.

Not sure what everyone is on about. Clearly Feaster was aware if the wording and I have to believe fully understood what the intention of the was, but since its not written clearly he was planning on challenging this and trying to circumvent the rule.

I've been successful at this dozens of times in my life with contracts etc which are poorly worded. It happens regularly. There is a reason so much effort is put into documents like this by lawyers. They are making sure there are no loopholes which is what the Flames were attempting to do here. He's not an idiot. It's actually an intelligent move

Also even though it is Eklund he stated that Bill Daly told him earlier this season that O'Reilly would not need to clear waivers.

Neither side clarified offer sheet so that was the issue.

Generally everyone thought that O'Reilly didn't have to clear waivers and in the end the NHL made a vague rule that was open to interpretation without clarity.

Do the Avs not have to put ROR on waivers to put him in the line-up? I dont understand how the Flames would have to but the Avs wouldnt... Please explain

I agree with every thing you said except the last sentence. I don't think it was an intelligent move, I think it was a very risky move that the flames could not afford to take. At best mediators, judges, what have you, would have had to been brought in for this. That takes time. This issue would not have been resolved by the time the 7 days were up. I actually don't think they could have started anything until the 7 days were up and after that it could have taken weeks. By the time a decission was made the flames could have been well out of it and handing the av's a top 5 pick.

I did like the poison pill money aspect to the deal. I am actually shocked that the Av's matched because of the money involved.

Assuming Daly actually spoke with Eklund, Daly most likely told him this when the lockout was still ongoing. From my understanding, O'Reilly had to pass through waivers because he played 2 games after the CBA was ratified on Jan 19.

In the new CBA, the team that ORIGINALLY had the players RFA rights and the player was on that (COL) teams reserve list, then he is not required to pass through waivers once the team matched the offer. This is all due to O'Reilly playing two games after JAN.19 this year.

If he didn't play any games in europe the flames would not have had to waiver him if they actually got him.
