The only thing I can think of is that it's being used to make it seem like the plaintiff was particularly sought out by the bar, thereby increasing the duty of care owed relative to the rest of the people in the bar. It seems like a pretty weak claim unless it's based on specific actions directed specifically towards her, which doesn't seem to be the case.
Oh, she's also not above average at all. I don't know where some of you guys live, but I pity you.

By herself, I agree, she is pretty good-looking. I'm a man who has always liked the curves on a woman, no sticks please. It's just, as many have said, the circumstances which she has put herself into that make her so damn unattractive.

This is the part I don't get, her lawsuit states:
“The nightclub would invite, encourage and permit physically attractive invitees, and in particular ... the plaintiff, to dance in order to promote liquor sales and a general feeling of fun and festivity,”
Is she really suggesting that there is some kind of a 'hotness police' at this bar that lets some people onto the dance floor and keeps others off? And if so, she is suggesting that these hotness police in some way were responsible for her dancing?

Actually, now that I think about it that does go on in some small ways. It's not as flagrant as you're suggesting of course, but bars definitely allow hot girls to get away with a bit more when it comes to dancing on tables or speakers or whatever.
