Default Pay Advice??

What are the laws when it comes to a final cheque with a company>??

I left Rogers on July 12th and the company that i work for still has not given me a final cheque..

I was supposed to be paid on the 15th of July.

Does anyone have any advice in order for me to get my final cheque??

Any help would be awesome..

IIRC they have 5 business days to get your final pay to you.

I know many companies prefer to mail it out so they have a record, so do they have the correct address on file for you?

I've heard they have 30 days to pay you.

Employee Initiates Termination

The length of notice an employee is required to give also depends on the duration of employment and should be in writing. The minimum notice requirements that employees are required to provide are:
  • one week - for employment of more than three months, but less than two years
  • two weeks - for employment of two years or more.
If an employee gives proper notice, the employer must pay all earnings to the employee within three days following termination of employment.
If an employee quits without proper notice all wages, overtime, holiday and vacation pay is due to the employee within 10 days after the date on which the notice would have expired if it had been given.

If you were an employee it depends on whether you quit with the appropriate notice or not. I forget the amount of days they have to pay you with either scenario.

So badly beaten.

What i could find is:
http://laws.justice.gc.ca/en/showdoc...:l_III-gb:l_XV

Quote:
Division XV

Payment of Wages

Payment of wages
247. Except as otherwise provided by or under this Part, an employer shall

(a) pay to any employee any wages to which the employee is entitled on the regular pay-day of the employee as established by the practice of the employer; and

(b) pay any wages or other amounts to which the employee is entitled under this Part within thirty days from the time when the entitlement to the wages or other amounts arose.
I don't know how accurate this is though.

Something I just thought of- what kind of work did you do?

For example, one place where I worked under a comission structure, I didn't get my final pay for 3 months. But we also got paid on sales that were finailized, so they couldn't really do it any other way.

It's salary plus comission... I got paid on the 15th which was no commission and at the end of the month i get my salary plus my commission from the last month..

Why not contact HR and ask where your cheque is? Then go from there based on the answer they give you.
