just sell her crap then, its not worth it. i dont think. Netx time make sure to get the damage deposit. Did you have an agreement written up with her?

Nope, which is why I think selling her stuff is better than taking it to court. Like I said, there is a caluse in the tenancies act for implied tenancy if you can prove it (which we can because her stuff is there and she still has mail coming there) but court is a pain in the arse as well. My question really is can I get in trouble for selling her stuff?

Alternatively:

Your downside is she will sue you. I would just prepare a letter yourself. Give her two weeks to pay you and make arrangements to mover her stuff or you will sell it.

After two weeks give her another letter telling her she did not comply with the initial demand and you now consider her stuff to be abandoned and you will be selling it to clear her debt and that you may pursue her for any shortfall.

Be careful because if you sell her stuff for $1000 she may be entitled to that. If that were to happen I would consider giving her the balance. You are not entitled to make a profit and it would look bad if she did sue you for the difference. A small risk but there nonetheless.

It is not worth the expense to hire a lawyer for what is a very small amount.

See, this is one of those situations where Mafia contacts would come in handy. There could sort this whole ordeal out with a minimum of fuss.

If you do sell her stuff, I'd be careful that she doesn't report it stolen. She can always claim that she picked her stuff up and then had it stolen from her.

Have your GF post up in her works lunchroom with a list of all the stuff for sale.

The ex-roomy is bound to see it and know you are serious.

Maybe it'll get her thinking about it at least.....

Hmmm...looking at your second link I believe I'm well within my rights to sell her stuff. I'll send her a registered letter advising her she has 30 days to reclaim it and move it and then I'll sell it after the 30 days. I don't think I need a lawyer to send a registered letter.
