So basically they are saying it is OK to run people over while driving dangerously if those people also had consumed alcohol. What a POS and I hope it backfires and just makes him look worse.

The Judge in this case has dismissed the crazy defense of they were drunk as well.

That defencemight work in a civil lawsuit to apportion the liability, but it's just meaningless in a criminal trial.
