There are laws now for Neck injury that do not allow them to go over approximately $4000. This is due to the high number of people that see $$$$$ when they get rear ended. That is why premiums are so high today. Be honest about your injuries and as mentioned above.... you will get better service. The other party is 1005 at fault and it is their Liability coverage that will pay for your vehicle wether it is repaired or written off. The fact that you do not have collision coverage play no part. Their insurance will pay for damages. Now if you were at fault..... no repairs to yours.
Document everything as it goes and you have 1 year to make any lawsuits for further damages.

are you suggesting that advice given on the internet may be the opposite of correct?
I was rear-ended over a year ago. I was pleasently surprised to learn that we were eligible for cash for our pain and suffering. sort of made me wish that i had suffered more.

As for the OP the best thing you can do right now is to send me an e-transfer of all your savings, RRSP, and cash advances on all your credit cards. That way double talking lawyers can't get their sticky little fingers on your money.

Yeesh will you all just move on from your pissing match already! Glad no one was seriously hurt because no amount of money is worth dealing with pain and discomfort for the rest of your life. I do however agree that maybe the forum isnt the best place to give a lot of serious legal advice. Your two cents worth yes of course give it, thats why Rathji came on here, to get opinions and advice. But give it to Rathji and not banter back and forth about whose right and who has their head stuck in the sand. There. That is MY two cents and I digress, go back to your bickering. Sorry for the delay in posting, last few days have been hectic.
Insurance Adjuster finally got back to me, so a lot of my questions about rental and car seats have been answered by them.
Thanks for all the advice and of course I won't be discussing details of the accident here (Sorry fotze!).

you can sit on the internet and do it yourself. All they have to offer is ACV (Actual Cash Value). In short, what your car was worth had it not been in an accident and you decided to sell the vehicle. Search vehicles that are the same year/make/model/km/condition. That will give you a good idea. Also, if you have had work done that you believe increases the value of the vehicle ensure you have the paperwork to back it up. You should know that not all work done on vehicles increases the value.
To be honest it's not rocket science

That's what I have been doing, his post seemed to indicate that I should be talking to a someone who sells them professionally, which is why I ased for clarification.

Market value is a pretty elusive concept, there is always a range and really no singular authority, though the various black books provide good guidance. If its a write off, the issue is, what would it take to put you back in the position you were? Often that includes GST on top of the purchase price if you're buying a replacement from a dealer.
In terms of what to do, Vlad is the man, he'll give you proper advice. That $4K cap for "minor" injuries is pretty crappy though.

I used the Ford Dealership/sales manager when my 05 Escape was written off last December. He gave me the cash value (GST included) which turned out to be on par with what my insurance company offered me. He was also the one that suggested that I send reciepts to the adjuster for any additions I had made. In may case it for $2,000 which included a new set of tires and brake work being done. It got me another $2,000 above the cash price.
If you don't know anyone that works for a dealership I would send a PM to Pylon. I'm pretty sure he could help you with that.
