Default Legality question regarding downloaded stuff

Would it be illegal to put freely available software on a CD and pass it on to someone for free?

Say a firmware upgrade to some device. Freely available on the internet, but person x doesn't have internet access, so I would put the upgrade on a CD and send it to them.

Again, it would be free.

freely available software is usually always free and can be copied ad infinitum and transferred to any media you want an infinity amount of times. I don't know why freeware would be an issue for the "Canadian DMCA".

Refer to the software liscense or the EULA if it comes with one.

The new copyright legislation has been tabled in Parliament and gone through first reading. It is by NO MEANS In Force yet. It hasn't even been debated in Commons.
