Best way to get out of a gym membership?
Hey CP braintrust,
My girlfriend signed up for spa lady back in July because of peer pressure but is no longer friends with that person and she cant stand spa lady. Is there any tips on how to get out of the contract?
What type of contract would this be considered? A direct sales contract or a timeshare contract? Who this be stated on the contract itself.
She is willing to pay the cancellation fee but you cant just cancel it and pay the fee.

My pal signed up for a gym and even got a physical trainer there that was going to help him lose all this weight, but decided to quit about 3 weeks later. He had paid his money already and signed the contract so he fabricated a big story about his father having a heart attack and being in the hospital and how he had to move back to live with his parents to support his mother during this trying time.
Needless to say, he got his money back and they canceled the membership.

Spa Lady is evil! I think their "trainers" are worse than vacuum sales people!
I won't get into my own story of how SL screwed me over, but I think the only clause I saw in my contract from 10 years ago was you were going to be moving a minimum distance away from one of their locations.... I'm not sure what kind of proof you would need...

I had a similar situation; I had paid ~$200 towards a membership and was moving back to Winnipeg. I tried to talk to the manager explaining that what they had from me already was more than a fair share of 2 months worth of gym usage, but they told me that they were going to go after me for the rest.
Not only did they put an "R9" on my credit report, but they tried to re-issue the R9 five years later so it would stay on my report longer.

I think if I remember correctly from my membership many years ago it is very difficult to get out of a Spa Lady contract. One of the reasons being that they have many affiliates across Canada, and I think North America. So if you say you are moving to anywhere that is close to one of their affiliates you can't cancel. However, with that being said Spa Lady has recently been acquired by another fitness chain so maybe they will have taken on their cancellation policy.
Yes their "trainer" are very aggressive. I remember when I signed up for my membership they kept grilling me to get the numbers of my friends to call and harass into a membership.

I used to pay a cancellation fee in advance just in case I got transferred (at the time I was being shipped all over western Canada or Australia every 6 months). Even with that in my contract it was a pain to get my money back. Legit or not the person running the front counter would just look dumb and puzzled and make it as difficult as possible for me to have my money refunded.
Not all gyms have this prepaid cancellation fee though.

How will that help his girlfriend get out of her gym membership? Or do you mean he should fake his own death so he doesn't have to hear his girlfriend complain about it? Or so that she can use the excuse of her boyfriends death to try and get out of the contract?
