Default Story of a ######bag: Any recourse?

My fiancee has had an unfortunate string of accidents lately. She was rear-ended 3 weeks ago, then on her way to drop the car off at the body shop some guy backed into her. The first incident went fine and the lady was nice and everything was taken care of. The second guy though has proven there are ######bags everywhere. He is saying that my fiancee hit him and now insurance wants us to split our deductables. There were unfortunately no witnesses, but the guy was complaining to the body shop about having to go through insurance because it will cost him. Renfrew Chrysler won't get involved though due to apparent "liability issues".

I'm just frustrated by this guy's apparent lack of any principles whatsoever. We've even tried calling him but since he's a tool and a gigantic p***y, he won't call back.

Any recommendations? Has anybody been through something similar?

To top the entire episode off, the day my fiancee was going down to pick up her car, she found that the sideview mirror on the rental car she had was smashed off. Pretty sweet.

It should be pretty obvioius who is at fault based on where the damages are on the respective vehicles. If her damage is along the side and his in on the back end or corner, that should paint a pretty clear picture. Just be firm with the adjustors. They LOVE dealing with pushovers. Put your foot down firmly but politely.

Was he backing out of a parking stall? If he was, apparently he is at fault

Where was the damage on both vehicles? Was it a parking lot? If it's going to be 50/50, both insurance companies have to be involved, whether he likes it or not.

That is part of the reason why I hate this site sometimes. 7 responses and only 2 were serious answers. The rest are just silly grade 5 jokes. Okay. One joke was funny.

Yes, so not make that 8 responses with only 2 serious answers.

I would get the police involved as well, after all it is their job. If they can't decipher who is at fault then unfortunately I think you're screwed.

This.

Seriously though, you should have filed a report immediately after. I have a buddy who got royally screwed just because the other party beat him to a police report.

Sorry, I have nothing else to offer. Just wanted to emphasize that a police report, whether you think you need one or not, is a good idea.

Good luck!

They're not going to CSI a simple fender bender. From my friend's situation that I just mentioned, he took the other party to court. Had photos from the accident and even had a police officer provide a damage report. The judge dismissed all of it because neither of them are "collision experts", or some other BS.

Obviously, this is an extreme case, but you never know what whack job is going to determine your fate.

get some magazines (naughty ones) and subscribe to them using the subscribe cards...and check off "bill me later" box.

he will have to pay and/or his wife will find out.

...and you are kinda doing him a favour by 'getting' him a subscription to nudie mags.

oh, better if you have is work address, too

Have you checked around the nearby businesses for security cameras? Also, a police report might help you get them.

If not, kidnap his wife and hold her for ransom Devil's Rejects style until he pays for the repairs or owns up.

I don;t have any good jokes about this, except to expound on the point of your gf getting rear ended, so I will tell a story.

One time, I was at the Tims on McKnight, in the parking lot, about to pull into a spot. A van in front of me, stopped and then backed up right into me. Turns out it was a hotel van transporting passengers to the airport. The guy admitted it was his fault, and he had to take the people to the airport and gave me his card, and said we would settle up later. So later I called him, and he told me to talk to his supervisor, who said to get an estimate on the damage to my bumper, and he would just pay the amount. It was $1100 and when I told him that, he goes "$1100???, I'm not paying that, the driver said you drove into him, when he was stopped". I was wtf? you c**t, you and I both know what happened, I'm calling my insurance, and I can't believe you're doing this when I let your driver get your hotel guests to the airport.
So anyway, it boiled down to the exact situation your gf is in as there were no witnesses, it was a 50/50 insurance claim.
I vowed from then on, I would always get the police involved, in any other similar situation, and not gaf if the person was taking his wife to the hospital to deliver a baby or whatever. It has never happened again.
Your gf can chalk it up to a lesson learned, like I did.
