While no judge should ever ever fall asleep while on the bench, he is there merely as a mediator. But he does have a larger role to play when they are talking about sentancing (which it is in this case). He shouldn't of fallen asleep. I don't think they have grounds for an appeal, maybe on the term of the sentance, but I think he was still convicted.
