Default Questions about bankruptcy

Looking to the great oracle again for a couple questions. Firstly it's not about me declaring but rather an individual I'm having a legal battle with.

Long story short is that I was awarded a judgement which he hasn't paid. Now there is another legal matter where he initiated a law suit that I have been told he has next to no chance on winning. Futhermore he is is default to my counterclaim against his original law suit.

Would the courts allow him to declare bankruptcy just to avoid having to pay the judgement and legal costs?

I'm thinking of hiring a collection company to try to collect money from him, which might be difficult because he doesn't use banks. Would I be able to send a garishee form to his lawyer, becuase the way I see it he is using the money he owes me to pay for his lawsuit.

Any thought or suggestions?
