The swing the guy patented was actually a side-to-side motion, parallel to the tree limb, not the usual perpindicular motion that you use on a normal swing. His swing can even go in an oval pattern if you are so inclinded (like a tire-swing).
That said, if you read the actual patent, there's a re-examination certificate and all his claims were cancelled. The who patented the stick should have all his claims cancelled as well.
