Isn't this part of the job and would fall under workers compensation and/or disability?
Looks like I found my answer.
While she was on medical leave, Pavlis said, the city's insurer paid her medical bills and provided disability checks.
Eichhorn, a 12-year department veteran, would not discuss the suit. Her attorney said those benefits, paid by the city's workers' compensation carrier, were not enough. The suit seeks an unspecified amount of money.
Sad.

This is the crux of the case:
If the Cosmillos had made their pool baby-proof, police would not have been called to the scene, there would have been no water on the floor, and Eichhorn would not have hurt herself, he said.
Were the Cosmillos negligent? If so, should they be excused because they suffered a tragedy?

Yes, of course they were. As a parent I'm fully aware of how children can get themselves into trouble very quickly and you have to childproof accordingly.
After saying that the police officer has to be aware of a situation that she's walking into. You're responding to a call about a toddler being pulled from a pool. There's every chance of water being involved in this situation. She's a police officer, it's a dangerous job. To sue the real victims of this story is asinine.

this isn't half as bad as the criminals that sue the homeowners they just got done robbing. i'll have to see if i can find some of the stories. one guy robbed a house and on the way out, slipped on a stair or twisted his ankle. he sued them and WON!!! i blame the lawyers.

Is it fairly common, or even remotely common for police to sue civilians when they get hurt? If a police officer showed up in the middle of a gang gun fight and got shot, I wouldn't suspect they would sue the criminal and his family because they were negligent with their bullets. Criminal charge, sure, but not civil. I thought they typically sued the police force? Now I am not that familiar with law, these are just my observations.

Her bills should already be covered by workers compensation and her employer. Past that, I don't know how she is going to justify going after the home owners if her bills are paid.

i'm trying to find it now. everything that is coming up is about the doctor that shot a guy trying to rob his house and the robber sued. it appears that b/c of this case many states made a law saying that any injuries sustained during the commission of a crime are inadmissable. the judge in the shooting case said basically anyone can sue, that doesn't mean they will win.
