Judge rules Genarlow Wilson should go free!!!
For those of you who haven't heard this story, Ganarlow Wilson was 17:
Quote:
|
A jury had found Wilson, an honor student, guilty in 2005 of aggravated child molestation for having oral sex with a 15-year-old girl during a 2003 New Year’s Eve party involving alcohol and marijuana. Although the sex act was consensual, it was illegal under Georgia law.
|
After he was convicted, the law was changed so that the crime would, from that point forward, only be a misdemeanor.
Quote:
|
“The fact that Genarlow Wilson has spent two years in prison for what is now classified as a misdemeanor, and without assistance from this Court, will spend eight more years in prison, is a grave miscarriage of justice,” wrote Judge Thomas H. Wilson, no relation to Genarlow Wilson.
|
But the Georgia Attorney General refused to release Genarlow, and even now is trying to overturn this decision:
Quote:
|
Georgia Attorney General Thurbert Baker said Monday afternoon that he had filed notice of appeal, arguing that Georgia law does not give a judge authority to reduce or modify the sentence imposed by the trial court. He said he would seek an expedited ruling from the Georgia Supreme Court.

This is just ridiculous... This guy was a huge football recruit out of high school and instead of this guy being a NFL prospect in a couple years he has been sitting in jail. That attorney general should be shot...

Good to hear he may be getting released. Hopefully not too late for him to still be able to do something with his life.
For those of you curious; our original discussion of the story was here: http://forum.calgarypuck.com/showthread.php?t=36748
(Please do not post in that thread; as this one should be used to discuss this new story. I think his possible release is worthy of a new thread.)

Good call, Ken. But he hasn't actually been released yet - the Georgia AG is attempting to prevent his release.

Whoops. I guess I was a little to quick out of the gate.
So, I was reading the article. If you had been convicted of having oral sex with somebody, would you not try to choose a defense attourney with a different first name?

Wilson defense lawyer B.J. Bernstein said she believes Baker is just trying to stop Wilson’s immediate release.

You have to wonder, just what does this AG have to gain by destroying
this kids life over consensual oral sex?

One less black person on the street? I'm not saying it's right, but maybe that is his thought process.

Heh, that's not what I meant to do (ie. insinuate racism as a factor),
I really wonder why the AG is intent on prosecuting this guy, even though
the girl involved, her mother, and numerous others agree that it was
consensual. Yet the AG still insists on prosecuting him for the full 10
years.
A new judge lessened it to one year. Yet the AG still insists on prosecuting
him for the full 10 years.
What does the AG have to gain by this?
(now that we've practically eliminated the racism factor)
You would think he would be watching is popularity over this one...but
he doesn't seem to care.

Sometimes it's not as simple as this. The Attorney General has to look out for more than just Genarlow Wilson and he's likely worried about the precedent this might set, having another judge modify a sentence that's been previously determined. It's pretty horrible that someone's freedom hangs in the balance of all this, though.

I took it as more of a consecending tone- like how you might say to a child "Well, we've learned our lesson now, haven't we?"

cause saying "That may be his process" means I am saying "The is totally racist. That is the only reason this could be."
It very well could have been his thought process. I was just putting it out there as a possible reason.

You're probably right but it's sad that our justice system is based on the adversial system and not always on justice. Perhaps it's time for the right person to grant a pardon.
