 I'm sure any number of mental health and/or child development experts would be happy to testify to the normalcy of his behavior.

			i dont think he'd actually get charged for the crime...he wouldnt pass the DA's "tests" that they have to give children under 8 years of age in court to make sure that the children know the difference between right and wrong. might be accused, but the charges (if any end up being brought) will get dropped. My husband's new assignment at the DA's office for Santa Clara County is to work in juvenile deliquency and a lot of the charged are under 8 years old, and 99% of these charges get dropped because of how ridiculous they are.....

			The letter also stated Blackwell's son, who Blackwell requested not be named in this story for privacy reasons, spent the day in in-school suspension (ISS) as punishment for the incident.

There is other ways to settle things besides lawsuits. The US doesn't need more of them.

This is one time a lawsuit is more than appropriate.
  
Just because there are frivilous lawsuits existing, doesn't mean that legitimate suits should be curtailed.

There are so many grounds on which a good civil lawsuit could be made. 
 
Could the district be charged on criminal grounds? This almost seems to constitute a psychological assault on a child.

			The teacher's aide should be fired.  Anyone who sees something sexual in something like this has issues, and shouldn't be working around children.
