Yeah, he really looked like the one encouraging them in the movie.... I don't know how they can even accuse him of that when everything is right there on film. They're probably just trying to save face with their friends and family for looking like idiots in a very popular movie.
What a precedent this could set. Imagine being able to sue for drinking and watching porn. Almost every man on the planet would be lining up to call their lawyers. (Once the porn is done of course)
I think it's actually an interesting case that will determine quite a lot about artistic freedom in the US. My take is that it comes down to the fact that the students did not give informed consent to be filmed and ridiculed in Borat, but rather thought they were in a foreign film. Being drunk when signing is also an issue, but secondary IMO. I assume this lawsuit and others were expected when this movie was being made.

Heh, serves those guys right. Though honestly, in this day and age, people seem to be able to at least attempt to sue over just about anything, its getting ridiculous.
