Default Alex Formenton files 20.5 million dollar lawsuit

https://www.tsn.ca/nhl/formenton-fil...nott-1.2198850

Quote:
Former Ottawa Senators forward Alex Formenton, one of five one-time National Hockey League players charged by police in London, Ont., with sexual assault, has filed a $20.5 million lawsuit against player agency Newport Sports Management Inc. and Wade Arnott, his former agent, alleging negligence, breach of contract, and breach of fiduciary duty.
Probably tough for him to juggle all these legal balls.

It is pretty rich that he is blaming his agent for having his hockey career go up in smoke.

There might be another reason.

Pretty weak argument against his agent, IMO

Not sure how many NHL agents would advise a 23 year old who scored 18 goals in the previous season to keep a $787k qualifying offer on the table.

IIRC the reason he lost his leverage in contract negotiations is the rumors of his involvement with the sexual assault started bubbling up.

Seems like a shot in the dark to get some NHL level earnings for what might be an unsalvagable hockey career.

This would be a very complicated case requiring weeks of evidence and testimony.

I wouldn’t rush to make judgement based on seeing none of that.

You don’t have to see weeks of evidence and testimony to know it’s a weak argument.

Because we lack details of the ultimate SA Case, it is especially hard to comment. What if his angle is regarding advice the agent gave him about dealing with PR during contract negotiations, for example?
Certainly not trying to dismiss allegations made against him in any way, but there are plenty of unknowns in this case. Way too many.

Yeah you do. You really have no idea what went down or was said.

You don’t have to look at the evidence to know a guy whose career earnings would have topped out around 3 million bucks max that asking for 20.5 million for damages is ridiculous. What is the other 17.5 million for?

And yet I can read the argument being made in the lawsuit and evaluate it solely on what it suggests went down and was said and what they feel the compensation for what it suggests is… and come to the conclusion that it’s weak.

This isn’t rocket science. For you it might be, I guess.

With $20M on the table, regardless of how strong the case is, I bet the lawyers lined up in droves to get a piece of the action in hopes they beat the 50% threshold of doubt.

No sympathy, but the statement of claim does shed some light into how much influence agents have. I hear a lot here about how stuff agents do is obviously the will of the player and they don't make a tweet without a player's blessing. I think it's the opposite. They wield a lot of control over largely undereducated young men.

Damages are often asked in huge amounts. That ‘s not particularly relevant to the merits of the lawsuit.

How many Oilers have gone through it? You probably have a lot of experience cheering for those suckers.

I think his case could have merit. We don't have the details to know.

Ottawa made him a qo, which his agents advised him to decline. His agents weren't able to reach a deal with the sens on contract renewal. It does seem odd and I could see a scenario where this might be due to negligence by the agent.

Well good luck to him on that, in Canadian law it is almost unheard of to ask for pecuniary damages 7 or 8 times in excess of your lost income. Unless he thinks he will get some sort of punitive damages or non-pecuniary damages (although I suspect other factors may be contributing to issues like mental distress for Alex) the only damages he can possibly be entitled to would be loss of income, which would be two years of salary (presumably at 787K a year since that is the contract the agent should have signed according to the lawsuit).

The best part about it is his claim for future lost income beyond the two years, like as if but for this agent’s alleged negligence this guy would still be playing in the NHL.
