Default Deadbeat Landlord

Hello CPer's…

Long story short... I took my old landlord to the Residential Tenancy Dispute Resolution Service (RTDRS) in Alberta - over a security deposit issue.

I was awarded judgement in my favor, as of Dec 4, 2020. His timeframe to appeal expired Jan 4, 2021. He is refusing to pay me.

Any ideas from anyone as to what my next steps should be? It is not a lot of money, but it is more the principle of the thing.

I appreciate any guidance and advice!! Thanks!!

Thanks TROUTMAN...

I did have a look through that document over the weekend. I suppose that is the only recourse I have - Writ of Enforcement.

(unless someone wants to go break his kneecaps for me?!?)

Do you know how that works exactly? The Writ... not the kneecaps!

Sorry to hear that.
I had looked into it with my previous deadbeat landlord who I had a judgement against (thankfully he paid up on the deadline I gave him despite some shenanigans where he said "no you owe me" lol).

IAMNAL but essentially you just file a bunch of paperwork and your judgement with Queens Bench and then file for enforcement. It's convoluted but the document troutman posted is probably the best guide you'll find.

Can you tell me if Queens Bench route carries a cost for me to file? (and if I can recover that cost with my judgement?)

Happy to hear that you're taking this all the way.

If its the principal, can you sell the debt to a credit agency or register the debt on his credit file?

I used to work at a bank and I'll tell you right now that we cared a lot about those types of things even if its a couple hundred dollars. If the guy is a landlord, someone is giving him a mortgage. If a bank sees on his file that he won't pay his debts, then they won't lend to him.

On pg 14 it makes it sound like yes - there may be costs associated (service costs, search costs, etc) but the fact that you can put them as a "probable cost" would make me think that yes, you can claim them back. I'd give the link a read through.

I would add up the costs, and contact him and let him know you'll be filing your judgement with the court, and that he would then be responsible for the costs as well as the original judgement. And that if he doesn't pay you'll file with his credit and the personal property registry.

Bullies sometimes back down when you can convince them they have well and truly lost.
