Default kermit's ongoing infill issues

There is an infill being built beside me. That in and of itself is not a bother, I did an infill. But this building is being so poorly constructed. It’s far too close to my house (inside the 1.2 m side yard setback) and they’re starting on the second floor joists only a week after pouring the footings.

My only recourse is to call 311, and they’ll have to bolster their fireproofing, but the lack of attention means that this house will permanently be ridiculously close to my house. I’m watching these guys build this place and it’s so poorly constructed. The floor joists are nailed to the foundation haphazardly - these places are going to sell for $850k, and they’re junk.

Can't you get an inspector or someone from the city out immediately to review and stop work?

Doesn't make sense that you are just stuck with it. They should have to tear it down and move it to the proper distance.

There is no way they are within code for that side yard, and its likely because they didn't get the proper development permit (different from a building permit). There is so little room between the house and the fence I'm not sure how they would ever do maintenance on the exterior?

Phone these guys up and complain and you can probably get this stopped in its tracks, plus they'll be forced to fix it on their own dime. This is exactly the sort of situation the appeal board is there for, when people just ignore the rules and think they can get away with it.

Kermitology, I'm pretty sure they can't have windows that close to your house. I sure couldn't on my garage. Is that going to be a patio door or something on the side? The wall would have to be fire rated, which it looks like it is. Soffits have to be non-vented and maintenance free siding.

That span over the front door should probably have a header beam of some sort, no? I'd call 311 right away before this goes to far. They should have had a foundation inspection and the property line issue must have been brought up then.

Yeah, my wife used to work at the city in subdivision, so she sent a message to the head of building regulations asking WTF. They won’t have to tear it down, but yes, they won’t be able to have side windows and will need to have much more fireproofing installed.

It that’s it. No fines, no requirement to build it properly. They’re also supposed to get an inspection when the foundation is done to ensure it’s at the right height. No way they did that.

Edit: I should mention, it's a contextual DP. They're just ignoring the rules.

That's nuts. Looking at those pictures I still can't believe they can build that close to the property line. Sucks that you have to live with it.

I bought a house years ago that had a two level deck put on the front not long before I bought it. Turns out the previous owner had a DP but neglected to get a BP (or vice versa, my memory is a bit foggy). City was pretty unequivocal that they were going to make me tear it down unless I got a ton of paperwork done and had it inspected in a pretty narrow window of time. Had to hand excavate all the footings and piles to show they were correct.

Looking back I really should have taken legal action against the previous owner, but it all happened right before I took off for NZ for a couple of months and when I got back I was too laid back to care anymore.

I would still request an inspector come out and take a look at everything. That looks very against code.

That's a tall wall opening. Looks like that's where the stairs are going.

That is ridiculous. You're going to have their trades in your yard all the time when they put in the windows, do the soffit fascia and siding, roofing nails falling into your side yard...

I can not believe that they are getting away with that unless you're zoned for zero lot line.

Unless that picture has some kind of weird pan dimensional distortion, their roof is going to be at or over the fence, so if theres a heavy snow or rain where there' run off its going down the side of the house.

I see. Maybe don’t rip out the fence then if it’s yours. But it’s on the table, it would make it quite clear that you’re not to be trifled wth.

I actually thought it was pretty remarkable they were able to build that close to the fence without damaging it.

Yet another reason in-fills GMG. Poorly built trash buildings that violate every standard of build set by the established neighbouring houses. Ridiculously large, towering structures that impede on every bungalows back yard privacy and sight lines, craming no less than two families onto what was once one lot, so children can play in a 30sq/ft yard while their parents pay through the nose for the privelage of looking like utter idiots for buying into a developers wet dream of quick easy cash.

I was super happy when my new neighbours up hill from me tore down the old bungalow and replaced it with a brand new, identical bungalow. The lot on the other side is not optimized for any sort of duplex infill so I should be safe.

Yeah, fence is mine. The problem is that their house is closer to the property line than is allowed, and then I came home today and they’re doubling down in what appears to be a cantilevered wall on the second floor.



I went over there to try and find a site supervisor, no one spoke English. If anyone pays market value for these dumps, they’re getting ripped off.
