Default Calgary defence lawyer jailed after dispute with judge

An investigation is now being conducted by Calgary police on whether any criminal charges should be laid against the lawyer, Ian Savage, who has been in the news in recent weeks as president of the Calgary Defence Lawyers Association advocating a better Legal Aid deal from the provincial government.

Savage said two other defence lawyers — Norm Kelly and Jim Edgett — had their cellphones confiscated as a result of allegedly trying to take videos of the incident in the hallway outside the 10th floor courtroom. He said they were evicted from the courthouse and told not to return that day. He said they had their phones returned later.

I hope there is a thorough investigation and any wrongdoing is handled accordingly.


I kind of side with the lawyer on this one without really knowing much other than his version. He knows the laws and I don't think he'd be stupid enough to break any especially while in court.

Read the article, it was his altercation with the sheriffs which got him arrested.

"There were words exchanged between the lawyer and judge, who ordered Savage to call his next witness in the continuation of the trial.

Savage refused and the judge ordered sheriffs to escort him out of the courtroom, with as many as four sheriffs involved in escorting him out."

Dude read the very next paragraph.

"After they left the courtroom, there was an alleged altercation between the sheriffs and Savage, leading a sheriff to arrest him and take him to a basement cell."

He was only being led out the court room originally, not arrested.

Well at least he Did not have this Judge. Guess which state this took place in ..... If you said Florida you'd be right. From a news story back in June.

Defence counsel Danusia Bourdon, who works out of the same office as Savage, said she was ejected by McIlhargey from a Turner Valley courtroom last week.
Two other lawyers were removed when sheriffs thought they were taking photos of Savage’s arrest."

When a judge tells you to move on in the case, you don't continue to argue. You can always appeal. I haven't seen a lawyer refuse to accept a judges decision on a ruling in a case before.

I think you could only appeal guilty verdicts. There are fewer options if the defendant is found not-guilty and you think the case should be reexamined (such as claiming a mistrial).

In Canada, the crown can appeal a not guilty verdict.

Sounds like jibber jabber to me. The judge does not tolerate jibber jabber in his court.
