However she should seek legal advice rather than look it up herself. Unless I am reading things wrong:
Quote:
What remains is a 10 year statute of limitations for child molestation. HOWEVER, the crime can also be prosecuted within one year of WHENEVER a victim tells the police (even past the 10 year mark). This sounds rather contradictory, because this means that the 10 year limitation is essentially pointless, but it is the current law of the land. The California legislature is constantly debating about this, so the law may change in the near future. You should talk to a California attorney familiar with these cases for the most up to date information.
Until a 3rd party either confirms the act the legal issues surrounding such accusations I would be very sceptical of believing someone just because they posted a video on youtube.

Did you even watch the video? She admits to it on the phone.

From the comments (Jamie X is the girl in the video)

JamieX: I don't even know where to begin. I am so grateful to all of you for making this video go viral. It is true. She did resign shortly after I had sent the link of the video to the Principals email. She is caught but not in custody. I was interviewed at the police station where I made my report to move forward with charges. Because of all of you who shared she will not be getting away with these things that she has done to me or any one else. I've shared my story with Sara Welch of Ktla5 and it will air some time tomorrow morning. Thank you all again.... I really can't thank you all enough!!! :*)**
Serious question: Wouldn't they have to prove it was the actual person on the phone somehow and not a friend pretending?
I'd imagine that wouldn't be too difficult. They can easily tell what calls came into the school, what time, which office the call was transferred to, which secretary transferred the phone etc etc.
I can't be the only one of the opinion that certain crimes should have no Statute of Limitations am I? I don't really care of a perpetrator is 90 years old and committed his crime in his teens, if he is guilty of a violent, or sex crime, prosecute him!

This is totally off topic, but how does a Statute of Limitations work with War Crimes?

According to Wikipedia (I know...I know, untrustworthy source, but this isn't exactly a university Thesis)
International crimes
By way of custom of international law, genocide, crimes against humanity, and war crimes are usually not subject to statute of limitations, nor to prescription. This custom has been codified in a number of multilateral treaties. States that ratify the Convention on the Non-Applicability of Statutory Limitations to War Crimes and Crimes Against Humanity agree to not allow limitations claims for these crimes. Article 29 of the Rome Statute of the International Criminal Court states that genocide, crimes against humanity, and war crimes "shall not be subject to any statute of limitations".

Wow, that was really hard to listen to...really left a sick feeling in my stomach.
Hopefully this teacher will gets all the appropriate charges and jail time she deserves. Chances are, if there one child that she was doing it to for years, there are more that have been afraid to speak up.
Seems like a weird thing to do over the internet..
anyways, in before South Park 'nice' pic
Well if she can't be convicted in a legal court, the court of public opinion is the next best thing.
Of course there is a chance she is innocent, but the people who answered the phone at the school likely would be able to confirm it, plus her voice is fairly unique.

It's a good thing there is no limitations on charging sexual offenders in Canada. Even if a child is abused as a kid they can charge the offender when they grow up and are an adult.
