Prostitution laws struck down by Ont. court

An Ontario court has thrown out key provisions of Canada's anti-prostitution laws in response to a constitutional challenge by a Toronto dominatrix and two prostitutes in 2009.
Ontario's Superior Court of Justice ruled Tuesday the Criminal Code provisions relating to prostitution contribute to the danger faced by sex-trade workers.
In her ruling, Justice Susan Himel said it now falls to Parliament to "fashion corrective action."
"It is my view that in the meantime these unconstitutional provisions should be of no force and effect, particularly given the seriousness of the charter violations," Himel wrote.
"However, I also recognize that a consequence of this decision may be that unlicensed brothels may be operated, and in a way that may not be in the public interest."
The judge suspended the effect of the decision for 30 days. It does not affect provisions dealing with people under 18.
Justice minister Rob Nicholson and Rona Ambrose, minister for the status of women, both said the government is concerned about the decision and "is seriously considering an appeal."

Definitely opens a can of worms for both sides. Of course Ottawa will appeal, I doubt they want a provincial court setting precedent for federal law.

It really should be legal everywhere..
I live in a country (Australia) where it is totally legal. It doesn't seem to effect the culture or society in a negative way.

I never understood why prostitution is illegal. If I go to the Back Alley, buy a girl some drinks, take her home and nail her, I end up spending the same amount of money to achieve the same goal. If anything, the girls on the streets are likely to be cleaner because some of them do get themselves tested regularly while I doubt the same can be said of most of the trashy girls that hang out in bars.

Sorry but there is no way in hell the girls on Calgary's streets are cleaner than a club hoe. Sure a club hoe isn't the cleanest tool in the shed, but the hookers in Calgary are diiiiiiirrrrtttyyy. This isn't western/northern Europe, the hookers here do it because they are forced to (for the most part) because of drugs, etc.

So I gotta ask......
If prostitution ultimately ends up being legalized, would you consider being involved in the business? I can't help but think that there will be a sudden surge in the need for good accountants, security, etc.

It is legal.
Living off the avails, soliciting, and running a bawdy house (whore house), however, are illegal. Basically, the idea is to make it illegal to be a pimp.
Quite frankly, with the invention of the internet I don't think girls are being forced into dangerous situations anymore. You don't need to hang out on a seedy corner to sell yourself. Put an add up on craigslist.
The people truly at risk are the ones who are forced into desperate situations by drugs, mental health, poor family lifes, etc.... Legalizing pimping will not help these women.

I don't undertand the logic that legalizes paying a consenting adult to #$% on camera and selling the video for a profit, but it's not legal to pay a consenting adult to do the same thing minus the camera.
