Servers with Cold Sores
First off, I have sympathy for people who get cold sores - I imagine they're uncomfortable and potentially embarrassing.
Having said that, I had a waitress yesterday who had a particularly large cold sore that looked to be weeping (the cold sore; not her) and I suspect she was picking at it whenever she'd go to the back because it was quite inflamed and little chunks of skin that were on it when I first sat down were gone later on.
Fortunately, this was a buffet so I ate my meal and hoped/assumed she hadn't touched the food, but I didn't drink anything she brought to the table as I couldn't be sure she hadn't touched the rim of my glass.
I have encountered similar situations to this a few times dining out, and it is always quite off putting. I'm not sure what the best solution is, but I'm pretty sure somebody with an open cold sore on her mouth shouldn't be serving food.
Does the restaurant have an obligation to keep employees with open sores like this away from food and drink?

Lol, the server was not picking at it. That would be extremely paiful. It's an open, yet dry, sore that originates in the nerve itself. Cold sores, by definition will get inflamed and swollen on their own. I don't get them myself, but about 30% of the population does.

Not sure I understand the backlash that Silver is getting here (except for the fact that Silver started the thread).
It comes down to hygiene in restaurants and this is really no different then if a server had a cold and was serving my food.
If the person is sick they should not be working at that time, especially in a service industry where you come in close contact with your customers.
This case is a little extreme since cold sores usually need to be transmitted from skin to skin contact but it can be concerning to have a person with an active weeping cold sore serving you your drinks and food.

Did you touch it? Rub it? Or did she touch you? If so, you could be at risk.
According to the link, it is spread from skin to skin contact. If she touched it in the back and then brought you two sides of ranch, the virus probably wouldn't survive on the side of the dish.
My conclusion: if your server has an active cold sore do not rub it or kiss it.
