Miracle Dog's former owner avoiding jail time

Basically, a pitbull was found nearly dead in a garbage chute. From the pictures you can see he's halfway to a skeleton when he is found. The good news is that the dog today is happy and healthy and is part of an amazing miracle story, but what I want to focus on is the punishment for the owner, Kisha Curtis.
Kisha Curtis, the owner who abandoned him, stated that she left him outside her apartment hoping someone would take him, but instead he was wrapped in a bag and dumped in the garbage from a third party.
She pleas not guilty to all the charges, stating that she only abandoned him, but did not starve him in any way.

I believe that her punishment has still not been decided, as she and her lawyers are trying their best to prevent her from going to jail.
I am curious to hear what you guys think of this? Personally I think she is an idiot. Leaving a dog outside is irresponsible, she didn't even try bringing him to an adoption centre or anything if she truly cared about it. And apparently, someone else who saw the dog tied outside put him in a bag and dumped him in the garbage. Guilty or not guilty? And what should be the extent of her punishment?

The probability someone other than the owner put him in the garbage is fairly slight.
She has to go to jail for that.
If you take a dog/cat into your household, you're responsible for their welfare and safety throughout their lifetime . . . . . and that's an eight to 16 year committment in most cases. It's a serious endevour and should be thought through carefully to ensure such a committment fits into your budget and lifestyle.
Nevertheless, I think about 50% of puppies are surrendered to shelters/other, new owners, etc, before they reach one year of age.
In our house . . . we were the third home for Ruby in her first 1.5 years of life, we were the second home for Pete in his 2.5 years of life, we were the second home for Polly and the six kittens she brought (we kept one, Skyler) in her 1.5 years of life and we took in two starving six month old kittens that washed up on a neighbouring acreage.
Lots of people chuck their animals to the curb.
Ruby and Pete . . . . . safe in their new home and still haven't been thrown into a garbage pile.

I would hope she is held responsible somehow. Seems doubtful that somebody else came along with garbage bags and tossed the dog in the garbage chute but even if that is true just leaving a dog outside without alerting any of the authorities deserves punishment in my mind.

Was this a finding of fact by the court or just what the newspaper says? Because from the first post she has a different story. If the court decided she was lying I guess she's guilty and it's a matter of sentencing guidelines.
