As long as it's legal I would buy it. This day in age, every business that interacts with the public needs a web presence. Even mom and pop restaurants need to have a website with contact information for reservations and menus. If your competitor doesn't even own their own domain then that's their oversight. I mentioned the legality only because of the linking to your website part.

There are cybersquatting laws against that in the US, but I'm not sure about Canada. I'd definitely do some legal research before going ahead with that plan though.

I'd be worried about cybersquatting, trademark, and passing off issues if you plan on taking his website name.

If the other company trademarked the name before the website was purchased there is little to no possibility Silver will end up keeping those address if it went to court.

Domain squatting, refers to “bad faith registration of a domain name containing another person’s brand or trademark in a domain name. And yes Canadian law is close to American law when it comes to Cybersquatting.

Now days you don't get away with this if its a company or product name.

On a serious note, it is dirty pool. One of our competitors had a similar issue, and the owner of our company actually notified them so they didn't get shafted by someone else. And the stakes were in the millions, not thousands.

Put up a simple page that says that XXXXX doesn't have a website, but you, being the helpful guy you are, know of another website that offers a much better product/service and include a link.

Why don't you sell it to your competitor for more money. Most likely their not going to set it up since they haven't already but at least someone else won't take their domain name.
