I got news today that Phase 5 will not be built. Strutural problems with the retaining wall! They put me on the Phase 6 waiting list, but really, I'll be paying way more than I bought the condo originally for. Any thing I can do about it?? This really screws me over as I thought I was moving into Blue Sky in either April or May of 2006.
I am passed off. Anything in the contracts that I can use? I need to review the contract. Anyone in the same boat? I remember some members living in Blue Sky.

I'm living in phase 4, and I heard that they won't be able to build phase 5 as high as they wanted, so they lower level units (Esprit) are being replaced with parking garages.
On MLS a little while ago there were some brand new units for sale in the complex.
Did you put your 5% down yet? or just the deposit? I would be very very passed if this happened.
I just moved in a couple weeks ago, and I saw the new pricing just came out. My unit (the cheapest one) is now $34,000 more than I paid for it. O_o

Hulk, I did put down my 5%. I spent almost a year looking for the perfect place, and now being so close to moving in, they want me to start from square one?? This is rediculous!!
I sure hope I can do something about it. I committed months and months ago, and now I am told I have NO HOME. Nice. What about all the other people who might be ending their rental contracts? Or people who are selling their apartments, houses, or condos? This really screws people over.

Bruce, phone them up and do some yelling. Don't call Jim or Maxine though, call up the office and keep b*tching until you get to someone very high up. They have a lot of explaining to do on that one (How could they not have known YEARS ago that a retaining wall couldn't be built there??)

I bought into the Streetside, 3111 Varsity across from the university and so far so good. They actually moved up our possesion dates 3 months. Can they not give you Phase 5 pricing for their Phase 6?

All good advice given so far.
I would call them and make sure you talk to the highest ranking person possible. Give them ultimate shinguard and tell them you want the condo in Phase 6 for the same price as you were going to pay. Threaten to call Tony Tighe and Lea Williams Dougherty and get them a whole bunch of bad press. (I would call them anyways regardless of what they do for you)
The contract states that you put your 5% down on a certain unit. If they don't have it available you should get your money back plus interest.
Someone on here is a Real Estate lawyer. I think it is Troutman, ask him I am sure he can help you.

Thanks everyone for all the replies. I will definitely do what some of you suggest. I really appreciate this. I know that this is affecting another member on this board as well, as I just spoke to him about the incident. He's pretty ticked off too.

How many are going to be/are living in Blue Sky?
I'm moving into Phase 4 next month.
Think of it this way... I understand that it sucks to have to wait longer, but would you want them to build it and have something happen to your belongings cause they decided to make a change?
We're going to have to have Flames night somewhere close... car pool or something.

I'm the other guy that got screwed by Streetside at the Blue Sky. I am super passed off as anybody would be after finding out that the home that they're supposed to get is no longer getting built. No, I don't want them to build a condo with problems, but I sure as heck expect them to do more than give me my money back and say "Oops, good luck with your search. Sorry you lost 6 month appreciation in a hot real-estate market. Sorry, to get you hopes up about your first home. Sorry, you spent all that time looking at places; do it again. By the way, you'll never find the same bargain again, but good luck". Any reputable company would do something to keep customers. They haven't offered shinguard.
The phase 6 is selling for about $40000 more than phase 5 for the same units! They probably have an escape clause, but for the company to use that escape clause and not offer any kind of compensation goes to show you how much they value their customers. Yeah, they could sell the phase 6 condos for $40000 more, but they will lose several potential customers for multiple times more revenue. Do they really think the irked customers are just going to take this on the chin without striking back?
I hope Streetside comes back with something. I really do.

I'm in phase 2 have been since November, can't believe this is how I'm finding this out!
God they seem like cowboys to me but then this is the first development I've been involved in, first time buyer and all.
So if I can get this straight, they're just not offering Phase 5, or they're offering parts of it?
I think the retaining wall at the back has been way problematic for them. During the monsoon season there were leaks and problems, which even in the recent dump have cause some leaks in the parking area. Much less and not a big deal. But still you don't pay 150,000 or whatever you paid for leaks of any sort. I think some of the woeful troubles and neglect they're having with individuals is the result of trying to sort out the retaining wall and the semi collapse in some areas of the hill at the back. They had to rebuild some of the city cycle path probably to the tune of hundreds of thousands.
anyway, would like to be kept up to date and share information so anyone want to pm me we can swap what we know etc. Also Prototype and Hulkrogan and Theycallme lets take over the condo board together!  (sorry not time for levity)
Speak to Debbie (from Streetside) and try using email as I have that creates a paper trail and keep riding them past their silent stonewalling, which is one of their tactics.
Not all doom and gloom here by anymeans but this is troubling news.

Here's the letter I got with my deposit cheque. I will only write down the important parts:
"Unfortunately, we have been unable to date to commence construction due tot he significant revisions to the design of this phase of the project necessitated in addressing previously unforeseen requirements of various municipal authorities and exacerbated by the complications arising out of the adjacent slope conditions.
Consequentially, Streetside's ability to proceed with the development and construction of Blue Sky Phase 5 had been significantly delayed for the reasons beyond Streetside's reasonable control and has caused Streetside to re-design this phase in its entirety.
Based on the above, we regret to inform you that Streetside will not be able to comply with Article 4 ("Preconditions") of your Offer to Purchase ("the Offer"), specifically, in relation to registering a condominium re-division plan, and creating separate titles for the units int he Project by June 30, 2006. Therefore, Streetside ehreby elects to terminate the agreement effective one week from the date of this letter. Please find enclosed a cheque for the full deposit amount that was provided."
I guess there's nothing I can do. All my time and energy, all for nothing. I will never be able to find a condo that offers me the same value again. The difference between phase 5 and 6 is $40k...
I am p1ssed off beyond words.
Edit: I am thinking of hiring a lawyer to look through my contract and see if there's anything that can be done. Seem like this is my only option left.

I would talk to a lawyer about it. They can at least give you an idea if you have a hope in hell of fighting them.
If I were in your situation I would be super passed off. You miss all that appreciation in a good market plus they just leave you out on the street. They should cut you a huge deal on the Phase 6 condos.
I would be all over Tony Tighe with this one. If they are going to screw you, then screw them right back. That shinguard just isn't fair to you guys.

A lawyer would need to review your contract to see what remedies are available. The New Home Warranty Program can also put a great deal of pressure on builders.

Thats because they took all the fataing crews off of the blue sky project because yours was sold out so soon they wanted their money right away, and as a result pushed all of our possessions back.
Don't get me wrong, I love where I live, but what a bunch of fataing clowns.

Really? how far did they push you back?
3111 varsity sold out so fast though. I had beg and hassle for my units because i was a little late in getting there. I did get 4 units in there for me and some friends and relatives but i think they just wanted me to stop calling them twice a day.

Yeah, don't put up with this. Your walk through should be done before your possesion date. Moving day is stressfull and you will miss things. You dont want the trades coming to fix things with your stuff in there and getting paint and drywall dust on everything. Bring a lamp to check all the plugs and use it to shine all the walls for defects. Trust me on this.
