The cop didn't let you explain how you were speeding in order to speed in a higher gear? Do you really think your engine would fall out?
My advice would be to pay the ticket since you were speeding.

Definitely a common spot for speeders to be caught, always cops at the top of the hill. You can show up, but you'll just plead not guilty and they'll set a trial date for approximately a year later. You can probably cut a deal at that point, but they're probably only going to go down to 15 over which is (i think) $89 and 2 demerits instead of the 3 for 17 over.

No, I'm able to safely drive in 5th at 60km, which is what I do, but the car doesn't like switching to 5th unless I'm at least 70 km. I had no intention of speeding

You really wanted to shift into 5th going up a hill? Fifth gear in a 60km zone doesn't make much sense to me. Mind you 3rd gear on a crotch rocket doesn't either

It saves gas being in 5th at 60km, and it's a low revving car, so it's not a big deal. I was just trying to make sure I had the engine going enough that when I shifted into 5th I wasn't going to lag the engine. They unfortunately just caught me at a peak 2 seconds where I was speeding

Why would a car require you to rev that high to switch gears? That seems like a complete design flaw given that your reasoning would affect millions of other drivers with a similar vehicle, and thus make themselves more prone to tickets...?

From the cars I've driven, 70km is pretty standard to switch to 5th

If you're really trying to save some money you could always go downtown to the courthouse and wait to talk to the prosecutor. The wait can suck but when you finally get in its usually like a 30 second ordeal and he cuts down the price. Don't know if they'll be able to do anything about yours though.
I'd say just pay it and be thankful you don't live in an area with speeding ticket Nazis. Moved to St. Albert after 5 years driving with 1 ticket. After 1.5 years here I had 4 more, now I just go the speed limit on the nose in this town. Great place to live but the driving SUCKS.
