How can I get out of the $120 penalty from Telus?
My wife's BB got damaged the other nite at a Xmas party.... some drunk spilled their drink all over it.
Anyways the cost to fix it is higher than the cost to replace it with an upgrade.
Seriously considering going with the Samsung Galaxy S Fascinate thru Telus as they have a $100 off coupon right now if I buy their phone and this would cover the $99 they charge if I sign up for the 3yr plan.... which is what I have now with Telus and the BB (Storm). I have 12 months left on my current plan so they are charging me $10 per month penalty to get out of the current contract.
BUT, I'm going to sign a new 3 year contract with them so this $120 penalty fee doesn't seem fair, as its not like I'm going elsewhere to Rogers or Bell.
Any advice?

wtf... i just did the exact same thing a week or so ago and i had to pay $130 to get out of the contact and another $99 for the phone... fml.
as an aside, the GPS sucks on the fascinate. just a heads up. but it does work.

It's a new contract. They gave you a discount when you signed your first contract assuming you would have that contract for 3 years, they want to be reimbursed for their loss. You want to enter into a whole new contract which would not effect or have anything to do with your first one.
It sucks but it's completely fair.

I agree that it's completely fair, but if you kick up enough of a fuss they'll probably cave. Rogers would, anyway.

Maybe. That's where I would start first.
However it's pretty simple, don't sign contracts for cell phones!!! It's a trap!

From what I gather is there is a promotion, $100 off coupon, which I assume is for 'new' contracts, so by upgrading he would pay $99 for the phone. Looks like re-signing is the best option in this case.

You negotiated a fair deal with Telus so they have every right to charge you.
The drunk that spilled the drink on the device should be compensating you for their stupidity.

Talk to the retention department and say the following.....
You: What steps do I have to take to transfer my phone number to another carrier?
Telus: Here is how and why you are moving?
You: I want to renew my contract with you guys but you are going to charge me to cancel me current plan. I only have 6 months left until I can officially renew my contract with you. If I want to renew it 6 months early and be loyal to you I shouldn't have to pay for it. So unless you can do something I would like to move my phone number
Telus: Let me see what I can do.
They will most likely not charge you to cancel.
Trust me, works for me EVERYTIME!

It seems he is looking at a NEW contract, not to RENEW his current one. If he wants to renew he pays $99 for the phone, if he wants a new contract he pays $120 to get out of it.

You are correct.
But I did switch from my BB plan to a data plan for my HTC a few months ago and it worked for me in that case as well. Still had 14 months left on contract when I did it.
also every retention agent is different, if one says no then call in again

I worked at Telus Mobility for several years. If there is a year or less on your contract, you should be able to get an early renewal with no fee. Follow the steps provided by Jus_Sum_Guy.
Depending on how much you spend in total on your accounts, you may be able to get the contract renewal earlier.
