Default Dealer sold me a sold car

Hey guys had a question maybe someone could answer.

Just last night I "purchased" a 2011 Ford Escape. It was a locate but it was located while I was there and the sale was proceeded with.

Financing was all taken care of and signed off on and has the VIN number and everything on it, everything was supposed to be taken care of just needed to wait a couple days for the vehicle to arrive.

This morning I wake up to a phone call stating that they were sorry but the other dealer sold my car...

Anyone know if I have grounds to be a hard ass in this situation? One thing they were trying to sell me was a protection plan(interior, rust, paint etc) that I know they overcharge on. Would I have a case to ask for this to be thrown in for free because of the mix up(whichever dealer screwed up should pay for it imo)?

If it was me I would just bail, unless your losing money by leaving. They don't deserve your money but if you take a loss bailing then I'd be a total dick to them.

Check the Ford dealership here in High River. The sales manager sold me my 05 Ford Escape and they were upfront and honest and easy to deal with.

I'd bail also. They should have checked to see if the vehicle was sold before you went through the transaction process.

The dealership was fine to deal with and gave me a decent deal, this really pissed me off though as now I may have to wait a couple weeks to get vehicle and I start a new job on monday.

You shouldn't have any problems getting out of the deal, after all, they can't produce the vehicle you signed the contract for. If they can get you the identical vehicle somewhere else, be fine with it, but if there's a vehicle closely that they can get that has a few more options, I'd try hard to get that vehicle for the same price as your contract.

If they present an option that doesn't inconvenience you any more than the original deal, just leave it. Not worth the hassle then.

If they screwed up they should give you a loaner vehicle until yours comes in.

Then tell them you'll buy a vehicle through them if they cover the cost of a rental until your new vehicle arrives

So put the squeeze on them to keep your business. See what they are going to do about it. Why would anyone suggest just up and bail and go through the whole process again? People screw up, it's how they handle it that counts the most.

I bought a car from Precision Hyundai, which they crashed pulling it out of the shop after putting winter tires on it. They had to ship a new one in from Winnipeg I think it was and the wait was a week - they gave me a car off the lot to drive until mine arrived. It costs them nothing really - the car on the lot is still considered new when they sell and seriously, how many km are you going to put on in two weeks?

Sounds to me like they haven't done really much for Murray1 except to call and say the car has been sold.

Well it depends, are you a latte-sipping urbanist or a culturally-devoid suburbanite?

Every time you post I have to go back and read the thread to see if we're reading the same thing.

They were fine to deal with and gave him a decent price. That's doing something for him, which is why Barnes suggested asking if they'd take care of this problem before starting from scratch at another dealership, which would be kind of a goof-ball way of handling the situation.

Maybe you should get your eyes examined.

He said "nothing" about what they were going to do for him since the vehicle he bought was sold by another dealership.

Well sometimes you got to ask for what you want.

I haven't dealt with it yet. I pretty much said ok when they first phoned me, didn't even think to recheck paperwork to make sure the actual vehicle and everything on it were there(hence making my whole contract void and will have to redo all the paperwork...)

Got some decent ideas from here and a couple other forums I visit, just phoning a couple places that do protection plans etc to compare their quotes and then will form a plan of attack.

My mother bought a 06 Escape form the same dealership as i bought mine from. The afternoon she went to pick it up the salesman said some vandal had made some serious scratches on it over night. They buffed out the scratches the best they could that morning and said they would give her another $2,000 off the price or she could cancel the deal and look for another one. She accepted the $2',000 off the salesman offered.
