Rape by deception: crime or no crime?

From the Vancouver Sun:

A Palestinian man has been convicted of rape after consensual sexual intercourse with an Israeli woman who believed he was Jewish because he introduced himself as "Daniel."

Kashur was accused of misleading the woman, whose identity has not been disclosed, by introducing himself with the traditionally Jewish name when they met on a street in central Jerusalem in 2008. After striking up a conversation, they went into a nearby office block and engaged in a sexual encounter, after which Kashur quickly left.

He got 18 months in jail.

What do you think? Does Kashur belong in the big house, or is the Israeli legal system just playa-hatin'?

Boiled down to essence, the guy was locked up for lying about being jewish.

Pretty sure this is called racism in North America. But in Israel, xenophobia is a cultural norm - hard to judge this situation objectively to be honest.

I suppose it's a step up from other parts of the world in that he didn't get stoned.

1) How did she ever discover who the guy actually was?
2) This skank must be related to the prosecutor or there is something else to this that's not in the story...

I'm assuming it was consensual at the time.

So she is now crying rape after a quicky in an alley? How did she find out that he wasn't Jewish? (assuming they didn't exchange a whole lot of personal information during their 15 minute relationship). As he was leaving did he drop a "haha gotcha bi**h, my real name isn't David...it's OSAMA!"

As another thread has pointed out recently...there are women of questionable morality everywhere.

"The court is obliged to protect the public interest from sophisticated, smooth-tongued criminals who can deceive innocent victims at an unbearable price - the sanctity of their bodies and souls," Segal wrote.

"When the very basis of trust between human beings drops, especially when the matters at hand are so intimate, sensitive and fateful, the court is required to stand firmly at the side of the victims ... otherwise, they will be used, manipulated and misled, while paying only a tolerable and symbolic price," he wrote.
