Other news articles indicate one was a known HIV carrier and one was too drunk to consent to sex. Though its not clear if the HIV and drunk are one and the same.
Either way, the officers have a duty to protect prisoners from one another.

I will admit to not being well versed in how prison works, but I would have thought there wasn't supposed to be alcohol. And it seems like it would be harder to smuggle in than drugs, because the volume is so much larger. Where exactly do you hide a bottle of liquor when you're getting searched on the way in?

So, if two people meet in a bar and are un-consenting-hammered before they engage in coitus, could they charge each other?
How does one know if they or the other are too drunk to say yes?
Finally, if they were sober, would it have been OK to let them have at 'er?
