Default Owed money by a golf course who isn't paying... options?

Here's the long and short of it...

Got married in September at a golf course. Part of the agreement for booking the place was that if our bar bill on the night of the wedding exceeded $2,000, we would receive $500 back on the room rental from the golf course. We went over $2k on the bar bill. At the end of the night, I spoke with the banquet manager who confirmed to me that we exceeded $2k.

Go on our honeymoon, come back, two months pass and still no money. Call the manager, she tells me that the office manager was away and just got back. They'll deal with it this week.

Another month goes by, nothing. Call again, get the same old,: "I'll look into it and get back to you." Still nothing. Sent a few other e-mails and calls that were not returned. It's been nearly 5 months now.

I've sent them another e-mail (cc'd to all the managers at the place I could find) and I'll call them again in the a.m. I have a funny feeling, however, they'll brush me off again.

What are my options, excluding violence, illegal methods of forced repayment, sobbing like a girl, giving up hope?

It's not a quick drive from where I live to just show up and raise hell. And, with it being the off season, likely won't get into the place to begin with.

Threaten to hire a lawyer and sue for the 500 plus interest due to the time past since the payment was due unless they are willing to settle. Since it is the off-season, money might also be a little more valuable to them.

If you have a contract of the agreement, put a lien on the golf course.

This is important. Make sure you have evidence that the offer existed at the time and a receipt confirming you spent over 2,000 at the bar. Without those you might be in a pickle.

Yeah, we have all the receipts and contracts etc. How does one go about putting a lien on a business? What are the ramifications to the business? Costs associated with it?

Not sure about all of this since I am still in high school, but you should shoot Troutman a PM. I am pretty sure he is a lawyer.

I think Troutman is a family lawyer, but I'm sure he could probably give some insight or refer you to a legal lawyer.

I think we have a lot of lawyers on CP actually...

I believe like fedr123 or something is one, CaptainCrunch, Vladtheimpaler... list goes on.

If you are going to talk to a lawyer about this, it is a good idea to speak to a legal lawyer. Illegal lawyers will only get you into more trouble.

Troutman is a real estate lawyer. He saw the light and managed to escape the family law practice some time ago.

While CaptainCrunch may have a checkered past and he may be an expert in many things (munitions, yelling at kids to get off his lawn), but I don't think he would appreciate being accused of being a lawyer. The rest in that list? Guilty as charged...

Seriously, though... based on what you said above I do not thing there is any way you can get a lien on the property prior to judgment according to the laws of Alberta. If you do obtain a judgment against the golf course from he courts, you can file a Writ of Enforcement and register it against property owned by the golf course. It may have a similar effect.

Assuming you have the "evidence", it looks like a very straightforward small claims case. It will cost you $100 to file the claim, but you will be able to recoup that cost. Make sure you do a land title search and a corporate search (via a registry) to find out who actually owns the land/operates the golf course. The amount involved is too small to hire a lawyer, but I would suggest calling the U of C Law School Student Legal Assistance at 220-6637 - law students will handle this for you for $25 just to get some experience...
