Car vandalized in ParkPlus lot - Question
Had a vehicle damaged in the Westside Rec Centre transit parking lot today between 7 AM and 5 PM. It looks like someone in the vehicle next to mine rested their drivers side door against my passenger door, then got in the vehicle causing it to rock back and forth. It created a horrible scratch in a zig-zag pattern about 8-12 inches long down the passenger door. There is no way someone could have done this without noticing the damage. Just careless.
My question is this, though. Does ParkPlus not drive through the lots and take photos of the license plates with that cool camera car I see around? If this is the case, is there any way that ParkPlus can use their camera to figure out who was parked to my right all day? If it was one single vehicle then it would have to be them, no? Do I even have any recourse if I were to be able to find out who was parked next to me?
I'd call them but their offices are closed 'til morning. Thought I'd try the collective braintrust here.
If you don't know whether I can find this info or not, what's your opinion on whether or not I should be able to if there is damage to my car.

My guess is that due to FOIP, they wont tell you anything. Couldn't hurt to try though.
Best bet to call 311 and have them start documenting it.

Do a walk through the parking lot next chance you get. Check the edge of doors for cars where the paint is all removed. That is a good start.
Get a magnifying glass and see if you can see the paint color left on your door, this may narrow down the cars for you.
My car is totally dinged from coworkers...it is amazing how little people seem to care.

ty, to hear. Not sure about the parkplus option, but what I can recommend is going into Westside and asking to review the tapes .I know 100% they have camera’s on the parking lots at all times.
How do I know this you ask? You know how only a fraction of that lot is for transit, and it’s always full (or was before they started charging)…well I figured since I had a Westside rec pass, I could justify parking in the members only parking, which always had spots, and take transit. They didn’t like that and decided to tow me.
Next day I called to enquire, as I suggested I was actually at the rec center all day, and not using it for transit as they assumed…Nope, they informed me they had video surveillance of me getting out of my truck and onto the bus on my way to work. ty for me, good for you!
Not sure of the resolution, or if they will even give you that info, but worth a shot.

question: I've been parking my car on private land and have no right to park it there.
the owner of the land put a notice on my car claiming the land is private property.
My next question is as follows: what will he do next? It's a parking lot that is closed because of construction, but I can get into it anyway. Will he call a tow company, and if so, will they charge HIM money to come out at remove the 10 cars that are there? If they will charge per car to the owner, I doubt anything will happen to me for parking in an abandoned lot... but if he can call them, they tow me and then only charge me to pick the car out of impound, I'll stop parking there...
Yes I realize I'm being a ###### and parking for free where I shouldn't... but it's only for another week... should I risk it?

Even if you find who was parked beside you I'm not sure there is anything you can do about it!
I might be wrong but aren't parking lots considered 50/50 when it comes to accidents and damage? If this is incorrect someone let me know because this is what I have always believed.

Even if you had photo evidence of the car beside, that doesnt prove he/she did it. It only makes it likely that he/she did it.

I think it was a joke. Someone posted in one of the chat threads that he liked to give poor ratings to random threads and then someone else attempted to bug you by posting that he was going to give your thread a poor rating for no reason. You must not have seen the post, so the joke was lost.

If the person who claims to be the owner has a legitimate claim, they can call parking control and get you ticketed or towed. If you get towed you will have to pay the towing fees, which will be part of the cost of getting your car out of the impound lot.

I think that's more of a default than a rule. Because parking lots don't really have the same "guidelines" (for lack of a better word) as roads do (less lane markers, traffic signs, right of way indicators, etc...). Therefore, proving fault is more difficult. If fault is clear, then fault is apportioned.
So don't go crashing your rusted out Taraus into a brand new Porsche in a parking lot.

Many (most?) car insurance companies in Canada are signatories to a claims agreement. Basically, the companies have agreed to determine liability based on a set of rules and charts meant to describe most situations where liability could be an issue. An insured (i.e., you) does not have to abide by these rules and can seek an alternate determination of liability (e.g., court, trial, etc.) but this is the starting point for most disputed claims.

Of particular interest is the chart at page 10 of the document.
And as far as parking lots go, the rules apply but "Any vehicle exiting from or starting from a parked position is 100% at fault." [see note to Rule 8 on page 6]

That happened to me. I had just finished backing out of a stall and I was starting to drive forward when some lady backed into the side of me. She paid for 100% of the damages.

My wife was 80% out of the stall but still backing up. Someone came around the corner a bit fast (too fast to deal with a car backing out at least) and crunched into my wife's car. Without getting a lawyer and fighting the adjusters, the insurance companies were sticking to their guns and holding my wife 100% liable.
I was told by the lower level lackeys that it was the rule. Too bad. I tried asking for her name and contact info. She asked what for. I told her their was a scratch on my front bumper and I was going to drive into the back end of the first person I could find leaving a parking stall and I planned to call her as a witness if necessary to testify to the inflexibility of this rule. Then she put me on hold and got her supervisor.
