You need the helmet too. Most people wouldn't recognize that as the Bat costume without the head. I wouldn't anyway.

It says the suit is officially licensed, and there's a lot of TM symbols up there, so I'm not sure that including the helmet would violate copyright... I think it's probably more than points on your helmet might not be so hot in the event of an accident. You could go through someone's windshield and gore them on your bat ears.

I don't think the mask would be street legal haha...good for a halloween costume though!
