Default A Small Victory for all of us that have a love/hate relationship with XpressVu

He alleged the two together meant that Bell ExpressVu was charging more than 60 per cent in annual interest, which violated the Criminal Code. According to court filings, about 33,000 ExpressVu customers are charged the administrative fee each month. The fee has since been raised to $25 and it is comparable to late fees charged by other companies.

Bell ExpressVu argued the fee was not an interest charge but was based on the cost the company incurred collecting overdue bills. The company also argued the class action shouldn't proceed because each customer has a different account and incurs different fees. In general, allegations in class actions must apply to all potential defendants in order to proceed to trial.

Mr. Justice Paul Perell rejected the company's arguments and certified the case. The judge said he regarded Bell ExpressVu's argument “as demonstrating the informal logical fallacy that students of logic know as ‘ignoratio elenchi,' which is the error of misstating an opponent's argument and then refuting the misstated argument and not the argument genuinely in dispute. This is sometimes known as a ‘straw man' argument.”

Judge Perell said Mr. De Wolf had demonstrated that there were enough common issues for all ExpressVu customers.

Go get em Mr. De Wolf. I like their programming but when it comes to treating their clients, they're worse then the Ferengi. They've ruined more than a few of my days with their lies, accusations and overcharging.

I love when people who dont pay their bills fight those charges? Pay your bills on time and you won't have to pay a reconnection charge....simple!

The thing that happened to me is that they overcharged me and after my many phone calls telling them that, they finally agreed. In the meantime I refused to pay their overcharges and I was constantly dunned for their bogus payments and charged extra for my supposedly late payments. Even after they agreed I was right they didn't correct the problem. This went on for months and they even accused me of stealing their signal. Yeah, right I'm paying over a $100 a month so I can steal their signal. I was so naive I didn't even know you could do that. The only way I could settle the dispute was to pay them what I was billed and than wait a few months until they finally reimbursed me. I was so sick of it, I agreed. They never paid me any interest on my money that they used. I can see having to pay a small penalty for being late but as the judge ruled, this looks like usury.
My story is tame compared to some others.

Bell or the Spawn of Satan as I refer to them now are horrible. I went to the CRTC with my problems. As soon as I involved the CRTC Bell backed right off, the $650 + dollars they claimed I owed was taken away right fast. Of course I haven't seen the last statement from Bell to say $0.00 balance but I have a email from they're dispute centre saying that it's $0.00 balance. I think my whole point of this post was to say Bell is evil, that is all.

I don't know that any of the main TV/phone/internet providers or utilities are truly any worse than the others. They all seem bad these days.

I just called Bell the other day about them double billing me for my HD PVR for the last three months after I upgraded from the 9200 to 9242. The matter was resolved within minuntes - now it should just take 3-6 months to show up on my bill, right?
