I see a big problem with this lawsuit, that yellow thing they put on the burgers is clearly not cheese.
That actually made me spit out my water....what a wake up call

On a serious note this lawsuit is a joke, even if he had an allergic reaction and is sueing them he should only be allowed to sue for a fair amount. $10M is a bit overboard, I wish judges would just throw these type of lawsuits out unless people are asking for a FAIR amount of cash for their troubles.

That should be tossed immediately. The stupid decision by stupid people not to call 911 is not a justification for a lawsuit.

As far as the original suit goes, its pretty damn hard not to tell when there is cheese on a burger. Again, stupid people getting what they deserve for being stupid. Toss this suit out.

I know I usually check my food before putting it in my mouth (lifting up a burger for example).

I probably would check it twice if I had some death allergy to cheese.

If people are so severely allergic to something that they have the potential to die when exposed to it, it is THEIR responsibility not to put themselves in situations that are life threatening.

Like, it is so hard to look at that burger to see if there is cheese on it?

No kidding there. I like this part of the article:

"By my count, he took at least five independent steps to make sure that thing had no cheese on it," Houston said.

Apparently he took 5 independent steps, but missed the most important step of all, physically looking to see if cheese was there.

That is priceless! I would be curious to see what 5 steps he took...

Personally if I had an allergy like that I would not be going to a place like McDonalds that a bunch of kids are working at making $6/hr....not to mention McDonalds isn't known for screwing peoples meals up or anything

Why didn't he just look at the burger before he started eating it? If I was deathly allergic to cheese, I know I would examine something like a fast food burger with a magnifying glass to make sure it doesn't have cheese.

Usually parts of the cheese is sticking out of the burger and sticking to the wrapper the burger was in.. Pretty hard not to notice

If you are deathly allergic to cheese, you should not even be entertaining the thought of eating at a fast food place where cheese is prevalent.

Just because of the fact he ate at a fast food place, there could be some miniscule piece of cheese in that burger, that the naked eye can not see. So even if you look at it, you might miss it.

I think in this case, the cheese was very evident. But none the less, if you have such severe allergies, the onus is on YOU to AVOID places and situations that could have the potential to be life threatening to you.

exactly. the story doesn't even say what the other people ordered either, so maybe McDonalds didn't even screw the order up and they just switched burgers. these people are no different then the Wendys finger chili scammers, hopefully they get found out

Makes you wonder if he is even allergic to cheese/milk in the first place. Most of these scammers aren't smart enough to figure these things out.
