Default Courts avoid potential racial profiling battle

Two men, accused of producing 40,000 marijuana plants in Northern Ontario are granted conditional sentences in return for pleading guilty. The sentence?

Nine months of house arrest and nine more months under a 10 p.m. to 6 a.m. curfew.

The OPP investigation began in the checkout line of a Canadian Tire outlet in Timmins. An off-duty constable, David Martin, became suspicious when he noticed Mr. Chu and Mr. Hu purchasing a pair of rubber boots and a pressurized water sprayer.

What might once have been considered alert sleuthing blew up in Constable Martin's face when he concluded that he had stumbled into "a trend of the Asian population conducting marijuana grows flowing north."
"If you are Asian and you're in Canadian Tire buying anything vaguely related to gardening, watch out," Mr. Lindsay remarked yesterday. "If they had been white guys, this would never have happened."
