Question for fellow ebay sellers.. I have recently had a problem with an ebay user, and he has messed up my perfect feedback record, when He was in the wrong. Here's the situation:

Had an auction up for a pack of stickers and a single ticket for the flames home opener. Started the auction on Tuesday Oct. 06 at 6:42pm. My rules for the auction were as follows:

"PAYMENT AND SHIPPING INFORMATION:

Please contact me with your payment and contact information IMMEDIATLY following the end of the auction. Payment is due within 24 hourse of aution end."

So, auction ends with a winning bidder at 6:45pm Oct. 11, so would need the guy to contact me immediately so I can get the ticket shipped first thing in the morning (to get it to him on thursday, game day.) I expect the immediate email and payment arrangemets right away, as stated in the shipping disclaimer, as of 4am no email.

I am now a little worried about shipping it on time, as I have not heard from him; so, i email him "i don't know that i'll be able to ship it out to you in time, do you want to pick it up on game day?"

next day (wed, oct 12) still no contact from the buyer, so, I give him another chance and email him:

"Hello.. I need you to get back to me, as I reallly don't want to leave bad feedback, but it has been over 24 hours since the auction ended and i have not even heard from you......"

The day goes by, STILL no first email, no payment, nothing!

Next morning (8am Thurs, Oct 13th, game day) I finally get an email from the buyer, 38hours after auction ends:

Date: Thu, 13 Oct 2005 08:09:43 -0600
From: Mark xxxxx <xxxxx@hotmail.com>
Subject: RE: ticket auction 6567844368

Hi,

I am sorry that I haven't gottne back to you sooner. Unfortunately the ticket was needed for a client and I am not in town, so... Since the ticket was not able to be shipped to me on time I have no use for it. I will not leave you negative feedback as long as you do the same for me.

Needles to say, I left him negative feedback as I am now stuck with the ticket, and the listing fee's. On top off all that, He has givin me negative feedback on my perfect record... and I am p*ssED off!

Anyone else have any Bullshinguard experiences like this? if so, how did you deal with it and were the results? Do I have to live with the bad feedback now, even though it was not warranted?

Thanks, sorry for such a long post, just wanted some advice, and/or needed to vent a bit....

I'm pretty sure you have a case there, its a binding legal contract entered when he bids. That is bullshinguard

Report him as a non-paying bidder and you can get your negative feedback withdrawn. He is 100% wrong and you are totally right if your story is accurate.

NPB's can still leave negative feedback. It can only be removed if it contains swears, or identifying info. As for mutual withdrawl, I wouldn't bother. It still shows on the feedback record as being withdrawn, which to me still says neg.

Have you responded to the neg? If so, be sure to be calm and "just the facts." Something like "Event ticket, no contact until day of event- NPB"

To me, when dealing with a seller with a neg, I look at how they handle it. If you show you are the bigger man, one neg amongst several positives; and that neg showing you are a person of character, means more to me than one more positive.

There is recourse and you can have the feedback removed through some kind of appeal process, but I can't remember exactly how to do it.

i wasn't scalping just wanted face value. couldn't find a buyer, so I threw it on ebay.

Seedy world of scalping? lol PUULLEASE....

why is it only illegal in Alberta if it is such a detriment to society?

yup, I had $10 worth of flames stickers, the ticket face value was $65, winning bid was $80. BFD..

You are scalping. You agreed to a price that was more than face value. You were breaking the law. You can't have any recourse when someone welches on an illegal transaction anyway. If you cared so much about your ebay profile, you should have just moved on, and not bothered with the negative feedback. You could have set a price at face value on ebay and kept your karma good and then this wouldn't have happened!

Only illegal in Alberta? It is illegal in a lot of places in North America and with good reason.

You scalped tickets, and then someone who you scalped tickets to didn't pay. Stop looking around for sympathy because you have come to the wrong place.

Judging by the response you guys are giving FG, I'm sure you're probably right up in the face of the scalpers on the C-train stand. I mean hey, the guy sold a ticket for an extra $10 and the mullet sporting losers with 40 seats making small fortunes should be thrown in jail, right?

Hey, I'm not going to give them any sympathy if they have a deal go bad either. Never said FG is a bad person, or anything, just if you start down the path of amateur scalping, you do so at your own risk.

again the stickers were $10, ticket was $65. price was $80, wow, I got $5 extra. So, because of that, The other guy shouldn't have to follow the law and follow through on his legal contract when he placed a bid? I didn't tell him to bid $80, the picture on the auction clearly showed the face value.

Again, you guys should get off you're high horses. You're gonna tell me if you were sellin your ticket and someone offered $5 more than face you wouldn't sell it?

ok, I admit i was wrong about that. it's illegal in Alberta, Ontario and Manitoba.

Also it is illegal in numerous states, as well as in saskatchewan, and also BC if I am not mistaken.... I don't see what your point is though, just because a law doesn't exist somewhere, doesn't mean you don't have to follow it.

Once again don't go looking for sympathy, because you don't deserve any.
