Man Throws Alligator into a Wendy's

Authorities in Florida have arrested a man accused of throwing a live alligator through a restaurant’s drive-through window.
He faces three charges related to the incident: aggravated assault with a deadly weapon; unlawful sale, possession or transporting of an alligator; and petty theft.
“It was just a stupid prank that he did that’s now turning into this; it’s stupid,” his mother told WPTV. “He’s a prankster. He does stuff like this because he thinks it’s funny.”

Lets get it out the way: Florida? Florida.
It seems to me that this is Wendy's fault for having drive-through windows that can accommodate airborne alligators, I cant imagine what they're going to have to pay.
Anyone could toss an alligator through the window at any time!

He picked it up from the side of the road when he was driving. No indication that he ever taped it's mouth shut. It's not a small gator. Is he like the crocodile hunter?

For someone who claims to have never thrown an alligator into a Wendys you seem to know a lot about throwing alligators into Wendys...

I love how his mom goes with:

Okay, I'll grant that 'Assault with a Deadly Weapon' seems somewhat extreme but come the fata on! He threw an alligator at people.
What was his intent though?
Do we care? Is this a thing that we're caring about now?
He introduced a dangerous animal into a group of people via air attack. An animal that is normally not known for their airborne prowess was introduced into a populated and 'non airborne alligator adjusted' environment.

I don't know about this.
Can't he sue Wendy's? For not having an appropriate environment conducive to (airborne) alligators? Clearly they have not taken the due care to ensure safety of the alligator regardless of they were invited, trespassing or tossed in.

He absolutely should be able to! And so should all of their employees.
Wendys did not undertake sufficient due care to their employees by ensuring that local, although traditionally non-airborne wildlife could not threaten their staff!
